Coffin Butte Landfill Update

On March 17, Republic Services filed an Oregon Land Use Board of Appeals (LUBA) notice of intent to appeal the Benton County Commissioners March 3 decision to deny the application to expand the landfill. Several parties filed to intervene on behalf of the county.

The appeal is presently suspended while some objections to the record are being resolved.

Once LUBA settles the record, Republic will have 21 days to file their rationale as to why the county’s decision should be reversed. Then the county must file a respondent’s brief answering Republic’s arguments within 42 days after the record settlement date.  Oral arguments are generally scheduled about two weeks after LUBA receives the respondent’s brief.

The oral arguments hearing is focused on legal process issues and normally lasts less than an hour. The public may watch the live process or recorded hearings. No public comment is accepted.

Because LUBA reviews legal process and adequacy of findings rather than policy merits, remands for additional findings or corrections are relatively common.
